Terms of Service

1. Agreement

These Terms of Service (“Terms”) are a contract between you and MCT Innovations, LLC (“we,” “us”) governing your use of LaunchListings.ai at https://launchlistingsai.com (the “Service”). By using the Service you agree to these Terms and to our Privacy Policy. If you don’t agree, don’t use the Service. If you use the Service for a business or brokerage, you confirm you have authority to bind it.

2. Who may use the Service

You must be at least 18 years old and able to form a binding contract. The Service is intended for real estate professionals and others marketing property they are entitled to market.

3. What the Service does

You give the Service facts about a property; it uses artificial intelligence to draft marketing copy (such as an MLS description, a portal description, social posts and an open-house announcement). Paid plans add features such as a saved agent profile and listing history.

4. You are responsible for what you publish

The output is a first draft generated by AI. It can be inaccurate, incomplete or unsuitable, and it may resemble text produced for others. Before you publish anything you must:

• verify every fact (price, square footage, features, availability, disclosures);
• make sure it complies with the Fair Housing Act, state and local fair-housing and advertising laws, your MLS’s rules, your brokerage’s policies, and any licensing or disclosure requirements that apply to you; and
• remove or correct anything that is inaccurate, misleading or inappropriate.

The Service includes safeguards designed to reduce the chance of discriminatory or steering language, including a phrase checker that flags wording for your review. These are aids only. They are not exhaustive, they may miss problems or flag phrases that are fine, and they do not guarantee compliance. We are not a law firm, and nothing in the Service or its output is legal advice. Compliance is your responsibility as the publisher.

5. Accounts and sign-in

To use the Service you create an account with your email address and sign in using a single-use link we email to you (there is no password). Keep your email account secure: anyone who can open that email can sign in as you. An account is for one person; you may not share it or let others use your plan. Tell us promptly if you believe your account has been accessed without permission.

6. Free plan

The free plan includes a limited number of listings per email address (currently three). We may change the limit, and may apply additional limits to protect the Service from abuse. Attempts to get around the limits, such as by using many email addresses, may result in blocked access.

7. Paid plans, billing and cancellation

• Price and renewal. Paid plans (such as Solo, currently $15 per month) are subscriptions that renew automatically each billing period until canceled. Prices are shown at checkout and may change for future billing periods with notice.
• Payment processing. Payments are handled by Polar, which acts as merchant of record and collects any applicable sales tax or VAT. Polar’s terms apply to the payment transaction.
• Cancellation. You can cancel at any time using the manage-subscription link in your Polar receipt email, or by emailing support@launchlistingsai.com. You keep paid access through the end of the period you already paid for; we do not prorate partial periods.
• Refunds. Because the Service is a digital product, fees are generally non-refundable. If you were charged in error or have a problem, contact us within 14 days of the charge and we will review it in good faith. Nothing in these Terms limits any refund right you have under applicable law.
• Failed payments. If a renewal payment fails and is not resolved, your paid access may end.

8. Acceptable use

You agree not to:

• use the Service to create content that is unlawful, discriminatory, deceptive or that infringes anyone’s rights, or to market property you have no right to market;
• enter personal or confidential information about other people that the Service doesn’t need;
• attempt to bypass usage limits, authentication or security features;
• scrape, overload, probe or interfere with the Service, or use automated means to access it without our written permission;
• copy, resell, sublicense or reverse engineer the Service, except where the law allows; or
• use the output or the Service to train competing AI models.

9. Your content and the output

You keep whatever rights you have in the information you submit (“Your Content”). You give us a limited license to host, process, transmit and display Your Content, including sending property details to our AI provider, solely to run and secure the Service for you. As between you and us, and to the extent the law allows, you may use the output for your own business purposes. Because output is generated by AI, we do not promise that it is unique or that anyone holds intellectual-property rights in it. You confirm that Your Content does not violate any law or third-party right.

10. Our property

The Service, including its software, design, prompts and branding, belongs to us and our licensors and is protected by law. These Terms give you a limited, revocable, non-exclusive, non-transferable right to use the Service; they do not transfer any ownership. The names of MLS systems, listing portals and social networks mentioned in the Service belong to their owners, and we are not affiliated with or endorsed by them.

11. Third-party services

The Service relies on third parties (for example AI, database, email, payment and hosting providers). We are not responsible for their acts or outages, though we choose them with care. Their terms and policies apply to your use of their products.

12. Availability and changes

We work to keep the Service available but do not promise uninterrupted or error-free operation. We may add, change or remove features, and we may update these Terms. If we make a material change we will give reasonable notice, for example by email or in the app. Continuing to use the Service after the change takes effect means you accept it.

13. Termination

You may stop using the Service at any time. We may suspend or end your access if you break these Terms, if your use creates risk or legal exposure, or if we discontinue the Service. On termination, your right to use the Service ends; sections that by their nature should survive (including 4, 9, 10, 14, 15 and 16) will survive. You can erase your saved profile and listing history yourself at any time.

14. Disclaimers

The Service and all output are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, non-infringement, and that the output will comply with any law, MLS rule or advertising standard.

15. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost revenue, lost data, loss of goodwill, or fair-housing, licensing, MLS or regulatory claims, fines or penalties arising from content you choose to publish, even if we were advised such damages were possible. Our total liability for any claim relating to the Service will not exceed the greater of (a) the amount you paid us for the Service in the 12 months before the event giving rise to the claim, or (b) US $100. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

16. Indemnity

You will defend and indemnify us against claims, losses and expenses (including reasonable attorneys’ fees) arising from Your Content, from what you publish using the output, or from your violation of these Terms or of any law.

17. Governing law and disputes

These Terms are governed by the laws of the State of Georgia, without regard to its conflict-of-laws rules. You and we agree that any dispute that we cannot resolve informally will be brought in the state or federal courts located in Georgia, and you consent to their jurisdiction. Before filing a claim, please contact us at support@launchlistingsai.com and give us a chance to resolve it.

18. General

These Terms and the Privacy Policy are the entire agreement between you and us about the Service. If a provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets.
